The Interior Regional Housing Authority (IRHA) would like to inform participating clients of all IRHA programs that IRHA staff is conducting a review of client accounts for compliance with agreement terms and program obligations. As part of this review, IRHA will be identifying and taking enforcement action on accounts with delinquent monthly payments, delinquent utility payments, and other violations.
IRHA has already identified approximately 50 client accounts that are behind on payments.
The IRHA will be issuing notice letters and Notices to Quit to clients with past-due payment balances and other outstanding violations.
IRHA urges clients to take these letters and notices very seriously. Agreements with the IRHA are contracts, and clients must comply with all terms and conditions. Failure to comply with the terms of an agreement is a breach of that contract. IRHA intends to process such breaches of contract, like non-payments or past due payments, in accordance with the terms of the agreements (contracts), applicable law, and IRHA policy, procedures, and practices.
A client’s failure to make timely payments, or to comply with other terms and conditions of their agreement with the IRHA, may lead to court action including eviction, ejectment, and/or a debt collection lawsuit. This may also lead to the client being ineligible for IRHA programs in the future. If IRHA is required to initiate a court action against a client, IRHA may seek to recover the costs of that action, including legal fees and court costs, from the client. If IRHA obtains a money judgment against a client, that client may be required to forfeit their PFDs in future years until the debt is paid off.
For these reasons, it is very important that you comply with the terms of your agreement with IRHA, including payment terms. IRHA staff may be able to work with clients to avoid eviction, and struggling clients are encouraged to reach out to the IRHA and other public, private, and tribal organizations to explore whether assistance may be available to them. Ultimately, however, it is the responsibility of participating clients to comply with their agreements in all aspects, including making required monthly obligation payments to the IRHA in a timely manner.
If you receive a notice from the IRHA, please promptly comply with it to avoid court involvement and possible eviction.
